About Stirling

Stirling is one of Scotland's newest cities and stands at the meeting point between Lowlands and Highlands.

Last year over 30,000 people were charged with a motoring offence in and around Stirling. Many opt to accept the punishment handed down by the courts. However, some join with Dominic Sellar, challenge their charge and fight for a fair outcome in court.

Stirling Sheriff Court and Justice of the Peace Court

Stirling Sheriff Court is housed within Sheriff Court House on Viewfield Place in central Stirling. Since  2009 the building had also incorporated the Stirling Justice of the Peace Court. Collectively they serve the surrounding population of approximately 45,000. The Sheriff Court will deal with the majority of local cases unless they are serious enough to proceed to the Supreme Courts at first instance or minor enough to be heard by the Justice of the Peace Court. The Justice of the Peace Courts hears summary cases by a justice of the peace, who sits alone or in a bench of three. Summary cases are less serious and do not involve a jury. The powers of a justice are strictly limited.

Falkirk Sheriff Court and Justice of the Peace Court

The modern Falkirk Sheriff Court was opened in 1990 on a new site near Camelon . Prior to this the court was located on Hope Street. The new building greatly increased the court's capacity and brought the Justice of the Peace Court under the same roof as the Sheriff Court. Falkirk Sheriff Court will deal with most offences unless they are serious enough to proceed to the Supreme Courts at first instance. Solemn cases are heard by a sheriff and a jury, while summary cases and civil matters are heard by a sheriff sitting alone. Falkirk Justice of the Peace Court hears less serious summary cases. Summary cases do not involve juries.
