Edinburgh High Court

Edinburgh Sheriff Court

Both Edinburgh Sheriff and Justice of the Peace Courts are housed in the same building. Together they form the largest court in Lothian and the Borders and serve half a million people. The Sheriff Court deals with the majority of cases unless they are serious enough to proceed to the Supreme Courts at first instance. Criminal cases are heard by a sheriff and a jury, while summary procedures and civil matters are heard by a sheriff sitting alone. The Justice of the Peace Courts hears summary cases by a justice of the peace, who sits alone or in a bench of three. The summary justice system does not involve a jury and deals with less serious cases. The powers of a justice are strictly limited. It is highly likely your case will be heard by one of these two courts.

Supreme Courts of Scotland

The Edinburgh High Court and the Court of Session, jointly known as the Supreme Courts of Scotland, are located in the Old Town of Edinburgh. These courts hear more serious cases and, unlike the Glasgow High Court, can hear appeals. Unless your case is of significant public interest or is particularly serious, you will not need to attend the Supreme Courts. The Faculty of Advocates and the Society of Solicitors are physically and procedurally linked to the Supreme Courts.
